CUSTOMER ACCOUNTS
You may need to create an account on ToughOutlet.com to use certain services or may be required to log-in to your account to make payment or check on order status. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account and you agree to accept responsibility for all activities that occur under your account and password. ToughOutlet.com reserves the right to refuse service, terminate accounts, terminate your right to use ToughOutlet.com or cancel orders at its sole discretion.
RISK OF LOSS
All purchases of physical items from ToughOutlet.com are shipped using third party shipping carriers. The risk of loss and title for such purchases is passed unto you upon our delivery to the carrier.
Conversely, ToughOutlet.com does not take title of any returned item, repair or items sent to us otherwise until the item reaches our service center.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
Any dispute or claim relating in the products or services sold or distributed by ToughOutlet.com will be resolved by binding arbitration rather in court. The Federal Arbitration Act and federal arbitration law apply to this agreement.
In arbitration, there is no judge or jury and a court review of an arbitration award is limited. It is possible an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow the terms of these Conditions of Use as a court would.
Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. You and ToughOutlet.com waive the right to a jury trial if the claim proceeds in court rather than in arbitration.
DISPUTES
By using ToughOutlet.com, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of California, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and ToughOutlet.com.
